@bongon , yes -- if he is not a US person ( citizen/GreenCard) and living abroad, he would be NRA.
Are you trying to file as Married Filing Separate ? Or are you trying for Married Filing Joint?
Which country are you in?
I will circle back once I hear from you , especially with any more questions.
Thank you, yes I´m filing married filing seperatrely, he is not filing for the same reasons. We live in Guatemala, he a Guatemalan citizen
@bongon , Yes TurboTax will insist on a TAX ID -- TIN ( SSN or ITIN ) for your spouse. To get around this you will have to file by mail.
For preparing the return you have two choices :
(a) Use a dummy SSN for the spouse viz. 527-12-3456. This should pass the Turo checks and allow the return to be ready to file.
OR
(b) Ignore Turbo need for Spouse's TIN. It will flag as an error but will not stop you from filing ( by mail -- not e-filing ).
(c) Once all done, select file by mail, let it do all the checks, just ignore " you have errors , do you want to proceed " type of message.
Print the return, Hand write in "NRA" in the space for spouse's TIN. Make sure the name of the spouse is correctly shown.
Sign, date and mail-in the return to the IRS ( IRS website will tell you where to send in the return ).
Is there more I can do for you ?
