Spouse began a new job in Texas 5/6/25, we bought a house on 7/18/25. TT tutorial said new job start date is the new residency date. What is the law/proof for that?

New Employer deducted KY taxes the whole year, and now have requested an amended W2 by the KY State to receive our full refund (He was in hotels while working in TX) and employer needs Form 740 instructions.

Are you confused about what year you are asking about?   Why are you talking about an amended W-2?   Are you really asking about 2024?   No one has received a 2025 W-2 yet.

 

If you relocated from KY to TX in 2025, the tax withheld for KY will not appear on a W-2 until you receive your 2025 W-2  in early 2026 from the employer, so that you can prepare a part-year state return for KY for tax year 2025.  And...if he began working and living in TX in May, that is when he ceased to be a resident of KY.   Owning a house in TX is not the criteria---living and working in TX is what matters -- whether he lived in a hotel or a home you purchased.

I am sorry- I AM talking about 2024. We just received 2024 KY refund which was 1000% LESS than we expected because the new employer took out KY taxes. I spoke to the KY Dept of Revenue and they require an amended W2 from the employer with an explanation. No problem there, but the employer wants to verify where I got the info that residency in TX is based on start date of new job.  I have combed through instructions, and online, and the only place I see it is in the TT software. Just looking for the law.
