Hello:

Yes, you can claim your brother.   He is a qualifying relative - the following excerpts also apply:

  • Are they a citizen or resident? 
  • Are you the only person claiming them as a dependent? 
  • Are they filing a joint return?

Hi Gs02rosa,

 

The answer could be yes as a "Qualifying Relative" as long as you provide more than 50% of their support, they live under your roof for more than half the year, that you cannot be claimed as a dependent by someone else and a myriad of other potential factors.
