Form 8915-E

I used the Qualified  2020 Disaster Form 8915-E for tax year 2020 and elected to spread the taxable amount over three years. I am aware that TurboTax does not currently have the form 8915-F included to complete this part of my taxes. I have a personal need to file my taxes early for FAFSA and Medicare related issues. Should I go ahead and file the taxes without this form and amend later when this form is available?

 

Also, if I were to choose to repay some of this money back to my IRA...is it too late to do that for tax year 2021?...or would I still have to claim that 1/3 of my original withdrawal?

Form 8915-E

You would be knowing filing a false incomplete tax return.

 

When you sign a tax return (either in ink or electronically) it says:

 

"Under penalties of perjury, I declare that I have examined this return and accompanying schedules and statements, and to the best of my knowledge and belief, they are true, correct, and complete."

 

You had 3 years to repay the 2020 distribution ir you choose that option on your 2020 8915-E.

I had no intentions of perjuring myself...only amending the return when the form is released, prior to the final tax deadline if possible. Some posters in this forum are stating that this form may not be available until May, well after the deadline. (Very frustrating that the IRS is requesting that we file early but does not have important forms available that I'm sure many people require.) 

 

Also, I believe you mean that I HAVE not had three years to repay any distributions.  According to IRS.gov:

"Q7. May I repay a coronavirus-related distribution?

A7. In general, yes, you may repay all or part of the amount of a coronavirus-related distribution to an eligible retirement plan, provided that you complete the repayment within three years after the date that the distribution was received. If you repay a coronavirus-related distribution, the distribution will be treated as though it were repaid in a direct trustee-to-trustee transfer so that you do not owe federal income tax on the distribution.

If, for example, you receive a coronavirus-related distribution in 2020, you choose to include the distribution amount in income over a 3-year period (2020, 2021, and 2022), and you choose to repay the full amount to an eligible retirement plan in 2022, you may file amended federal income tax returns for 2020 and 2021 to claim a refund of the tax attributable to the amount of the distribution that you included in income for those years, and you will not be required to include any amount in income in 2022. See sections 4.D, 4.E, and 4.F of Notice 2005-92 for additional examples."

 

 

Form 8915-E

If you file without the necessary form then it *is* incomplete, but people do that all the time.

 

That is what I said, you have three years to repay it if you elected the 3 year option in 2020.    If you paid all the tax in 2020 the it is too late to pay it back not - the Gov will not refund the tax you paid in 2020.
