if you're married on 12/31/2022 you can file a joint return, provided your spouse consents, even if your spouse has little or no income of their own. Most likely filing jointly in this situation will cost less in federal taxes than if you use the MFS option but MFS is allowable. however the only way to be sure is to prepare 2 MFS returns (both returns must use either the standard deduction or itemization) and compare the total taxes to a joint return. unfortunately, this is not really possible with online.
