Partnership LLC with my spouse for a daycare run out of our home. K1 Deduction Question

We're 50/50 partners in an LLC for the daycare that she runs out of our home.  She gets guaranteed payments, but I do not claim any.  The LLC did build quite a bit of capital this year, half of which shows on my K1 as income for me.

 

My question is, do we both claim the same home office deductions?  Or are we supposed to split the total deduction in half as well?  Perhaps one claims it and the other does not?

You may claim a Home Office Deduction on your personal tax return if the LLC agreement requires you to pay supplemental expenses for which you are not reimbursed. TurboTax will ask you about this during the Schedule K-1 interview if you check the first box under "Describe this Partnership."

 

The best choice on how to claim these expenses depends on which K-1 has the greatest taxable income. If they are essentially the same, then split the costs and report Home Office Expenses on both K-1s.

 

Per the On Demand Guidance for Miscellaneous Supplemental Expenses:


You can enter home office expenses for your partnership on this screen, but you'll have to use an IRS worksheet to figure out your expenses, first.


We recommend using a worksheet from IRS Publication 587 Business Use of Your Home to figure out your home office expenses.


First, choose only one of these to fill out:
-The Worksheet to Figure the Deduction for Business Use of Your Home is useful for tracking all expenses related to your home office.
-The Simplified Method Worksheet calculates your home office expenses using the size of your home office and a fixed deduction of $5 per square foot when your home office is 300 square feet or less.


Once you've figured out the amount, you can enter it on this screen along with "Business Use of Home" in the description field.
