Overpayment of FICA when two W2s are received from the same employer

Hello,

Is there a way to file online and receive credit for overpayment of FICA.  I had two different roles, each within a different division (each a separate legal entity) of the same employer in 2019.  As such, I received two W2s, with a combined overpayment of FICA.  The employer has provided a form stating that due to the fact that each division of the company is a different legal entity, they withheld excess FICA, as required for each of the two divisions.   The EIN is the same on both W2s - how do I account for this in Turbo Tax.   The employer has recommended filing on paper and providing the IRS the letter they have provided me, but this will cause me to go to a tax service and spend extra money to file my taxes, when this is the only outstanding issue.  Is there any way to receive credit for this situation in the 2019 Turbo Tax software?   I have had a similar issue with the same employer in the past but the Turbo Tax software of years past recognized the over payment and provided credit - not anymore.

Overpayment of FICA when two W2s are received from the same employer

When excess Social Security is withheld due to having two separate employers, the excess is automatically included as part of your tax return and applied to your taxes like any other tax payment.  

 

However, in your case, even though your employer states that you technically worked for two separate legal entities, they are using the same Federal ID number.  For tax purposes, it looks like the same employer.  Therefore there is a more complex procedure to follow for getting a refund of the excess tax that was withheld.

 

The following TurboTax article will describe the steps you need to take in detail, with links to the Form 843 that needs to be filed and sent separately to the IRS.  When you complete this form, be sure to include a copy of the letter from your employer that explains the situation.

 

Click the Single Employer link within the article and follow the instructions under the section What if my employer can't or won't cooperate?

 

Following these instructions should allow you to go ahead and e-file your return, with a request for refunding the excess taxes submitted separately.

I'm pretty sure when you fill out your w2s in turbo tax, including fica tax withheld amounts, turbotax will compute any overpayment and include it in your refund.    This is what the link below indicates
