When excess Social Security is withheld due to having two separate employers, the excess is automatically included as part of your tax return and applied to your taxes like any other tax payment.  

 

However, in your case, even though your employer states that you technically worked for two separate legal entities, they are using the same Federal ID number.  For tax purposes, it looks like the same employer.  Therefore there is a more complex procedure to follow for getting a refund of the excess tax that was withheld.

 

The following TurboTax article will describe the steps you need to take in detail, with links to the Form 843 that needs to be filed and sent separately to the IRS.  When you complete this form, be sure to include a copy of the letter from your employer that explains the situation.

Following these instructions should allow you to go ahead and e-file your return, with a request for refunding the excess taxes submitted separately.
