My return has been rejected because I haven't included a 1095 a form. I didn't have insurance through the marketplace in 2021. I had insurance through work. What to do

If you have e-filed your return and gotten an IRS rejection code for Form 8962, it could be because there is a partial entry in your return or because they have information from Healthcare.gov about Marketplace insurance and are looking for a 1095-A on your return to match their records. This might be because you or someone on your return began an application for insurance but did not actually enroll, or for some reason, Healthcare.gov erroneously has something connected to a social security number on your return. Forms 1095-B and 1095-C do not need to be filed and should be kept with your tax records. Please do not enter their information into TurboTax.

When our interview section Affordable Care Act (Form 1095-A) for the Marketplace insurance reaches the screen, Did you receive Form 1095-A for your health insurance plan? It will default to "Yes." If you select "No" and Continueit will not generate any Form 8962 information into your return. If you come back, it will default to "Yes" again, but it remained the "No" you selected until you came back into the area. This is as it should be.

In TurboTax Online, to ensure there is not a partially completed form in TurboTax, please check here to delete the form from your return. This will delete both the form and the entries. Please check for any Form 1095-A and also Form 8962.

  1. To Delete a Form go black menu bar on the left
  2. Click on Tax Tools
  3. Click on Tools
  4. Under Other helpful links, click on Delete a Form
  5. Scroll down and check for 1095-A or 8962  and if there is one, click on Delete
  6. Click on the blue Delete Selected Form
  7. At the bottom, Continue
  8. Repeat until any Form 1095-A or From 8962 are deleted
  9. At the bottom, Continue with my Return

If you have already checked online at Healthcare.gov for Form 1095-A information and do not find what you need, you may wish to call them and see if there is any reason they would have told the IRS to expect a Form 1095-A. You may reach them at:

1-800-318-2596

(TTY: 1-855-889-4325)

Available 24 hours a day, 7 days a week (except holidays)

Once you have resolved the Healthcare.gov information, the IRS should accept your e-file. In the past, they would accept the e-file but then route the returns with Marketplace questions for special processing that caused significant delays. This way the issue can be addressed, and your e-file should not be further delayed after it is accepted.

You may wish to file an extension today with an estimate of your taxes based on the information you have already entered and contact phone support later in the week. That will give you until October 15th, 2022 to file the full return.  If you will owe taxes, you will want to pay an estimate of that now, so you will only on interest on any extra amount. If you pay too much, it will be refunded to you.  Please click here for a TurboTax Help article with information about  TurboTax Easy Extension found at the bottom of the left menu bar.  TurboTax Easy Extension

So, I tried to file my taxes and got the same message. However, I called the marketplace and they actually have no records of me having a 1095 A form. What do I do?

Someone was saying fill out a dummy form, just so the system would let it through. But idk how to do that, so I ended up filing through Taxact.com

Hi- so just a friendly warning for all... I followed the "turbo tax expert's" advice and entered zeros on the 1095-A form because it would NOT let me delete it. I verified twice with marketplace and they confirmed I did NOT have any coverage in 2021. I have been on my employer's health insurance for years. My return was accepted. I was happy until yesterday, I received a letter in the mail from the IRS requesting I send a 1095-A form because it was not properly filled out. So now I'm back and forth with the IRS on this. Turbotax- I will not be using your services again. I followed your instructions and now I'm fighting with the IRS over a ridiculous issue that I have no control over.

Do not follow that advice entering zeros on the 1095-A form. Use a different platform to file your taxes.

Just because you could circumvent the IRS  rejection to get the return efiled doesn't mean the IRS will not be asking about this situation later.  You must now  resolve this situation you avoided earlier... this was not a TT error... it is the IRS that is confused.  So since the IRS believes you had ACA insurance and was issued a 1095-A then you have to prove them wrong.  Respond to the notification with some kind of proof that you did not have ACA insurance at anytime during the year ... contact the ACA and get to the bottom  of this situation.  www.healthcare.gov

I had the same issue and after hours on the phone with the IRS and the marketplace, found out someone had fraudulently opened a Marketplace plan under my husband's SS# for 2021 and 2022. After almost 2 months, we were sent a voided 1095. No one with Turbo Tax or H&R Block could help me. I had a fraud case opened with H&R and it never got resolved. I was told they knew of a bug in their system. Turbo Tax was no help at all. Someone with Turbo Tax told me after being rejected 3 times for e-file, the IRS will keep rejecting. I ended up having to send my taxes in by mail, so I will probably never see my refund.

The same thing is happening to me today. I called turbo tax twice and they reccomend I call the Market place to see if I have a plan with them. I call and I don't, they  have no records of 2022 service. I am not sure what to do, my taxes have been rejected twice today because of the same issue. I do not have a 1095-a form... I only have a 1095-c form.

Can anyone help?

Since this is the IRS rejecting you, if the Marketplace does not have any record of you having insurance, you could contact the IRS at 800-829-1040 to see if they can tell you why they believe you had insurance through the Marketplace.

If they cannot tell you why, then some people are having success by filling out the 1095-A section with 0's entered for the Marketplace Identifier and Policy number and with $1 for the month of January in column A.  Leave everything else on the form blank.  This will give the IRS the form their system is believing it needs and rejecting you for, but will not have any actual affect on the numbers on your return.

Did the marketplace check under both your name and SS#? They had to find our fraudulent policy under my husband's SS#. Nothing is found under just his name. He was hit yet again in 2023 so we have to do it all over again next year.

A warning to all:

Vanessa, I did what you said (last year I might add, your response is very delayed). And now I’m dealing with the IRS who accepted my return but says my 1095-A form is incorrectly filled out because there are zeros and a $1 in January. I’ve had to send loads of supporting documentation to prove I do not have Marketplace Insurance. And when I spoke with the IRS, they believe this is an issue with TurboTax including the form when it should never have been added to my return in the first place. It is beyond infuriating you are telling people to do this. It only leads to a bigger headache with the IRS.

You recommend calling the IRS? A joke. Took me multiple days on hold for hours to get in touch with a representative. They are one of the most understaffed sectors in this country.

Then it made you pick a premium plan it will not allow you to do it with the free edition.

Make sure that no one on your tax return has insurance under the Marketplace.  This is usually identified by social security numbers.  Sometimes dependents may be covered by the Marketplace.

I do not understand your statement about it made you pick a premium that would not allow you to use FREE edition.  Because of the form 1095A you are not able to use the Free Edition?
