Since your daughter is covered by the Marketplace and she is on your return, you will have to get a copy of the 1095-A and include it on your return. You will have to also find out what percentage her mother claimed for the policy amounts. If she claimed 100%, you would claim 0%.
thank you, but i cannot get a copy of said form from the mother because she will not give me a copy of that form. is there another way?
Unfortunately, the only way for you to get the information is from the mother. Because she is the policyholder, even if you called Marketplace Insurance, they would not give the information to you.
I am not sure if this is possible, but is there any way you could explain that you need to report the information for yourself on your return. The information you need is the top half of the form which contains:
The next section would just list your name, social security, date of birth, and the policy period.
The next section is a list of the months with 3 columns, you need the information to fill in for each of the 12 months and each column. The easiest way to divide this up and has been accepted by the IRS is to divide the total in each both by the number of individuals on the policy. So in your case, you would divide the amount by 3 and you would enter 1/3rd of the amount in each column for each month as the original form shows.
I assume she would have only reported 2/3rd of the amount. Even if she reported the entire amount, you still need the top half so that you can enter the information, advise it was reported by someone else, and enter $0.00 on the entry screen.
IF you absolutely cannot get the information, you would have to paper file your taxes. When the IRS gets to your return, you will get a letter asking about the 1095-A. At that point, you could provide the information you have to them and explain that she refuses to provide you the information to report your share on your taxes. I believe, if you respond to their correspondence with her name, address, birth date, and social security number, they could look the information up and possibly at that point provide you with the information you need or waive the requirement if she already report the information.
