My ex is had his girlfriend claim our daughter on her taxes. She was flagged because I already claimed her because he doesn’t work and he owes back child support. Can the IRS tell that she is not related to my daughter at all, that she is filing to avoid having my ex pay his back child support and filing fraud? Currently she stayed with my for 7-8 months out of the year and now in the process of custody case. I think it was very shady how they went about it when I work every day to support my children and she had no issue thinking she can file a child that isn’t hers.
To be able to claim a child as a dependent,the child must have lived with you more than half the year unless the custodial parent gives the other parent the right to claim.
