Yes, you can use TurboTax if you are a US citizen or a US resident. A nonresident alien cannot use TurboTax since the program does not support IRS Form 1040NR which is to be filed by nonresident aliens.
Yes - but the question we both have is, how can we attach the 8854 expatriation form to our US federal tax return if we submit the US federal tax return via TurboTax? is there a way to attach the 8854 PDF when we submit our 1040, for example? The US requires that the 8854 is submitted both as a copy sent to the IRS and as an attachment to the tax return. If we can't attach the 8854 when we submit our 1040, it would suggest that we cannot do electronic filing the year we need to submit the 8854 expatriation form. Can you be clear please in your answer? As this is a specific stipulation from the IRS.
As mentioned above, TurboTax does not support Form 8854. The software also does not support PDF attachments to electronically filed returns.
If using TurboTax to prepare your final return, you will need to print the return and file it by mail.
You will also send a copy (marked as such) of the Form 8854 (without the tax return) to:
Department of the Treasury
Internal Revenue Service
Philadelphia, PA 19255-0049
If you are subject to annual reporting of Form 8854, subsequent forms will also be sent to the Philadelphia service office.
It is only possible to file this form using TurboTax if you are filing a full-year resident tax return on Form 1040, and you print the return to file by mail with the Form 8854 attached.
If you are filing form 1040NR, or are filing a dual status return for your final year, TurboTax is not right for you this year.
It is generally our recommendation that taxpayers filing Form 8854 seek the advice of a professional with experience in this area, as there are many instances where this situation can be quite complex (though it may not always appear to be the case.)
