Infertility deductions

My spouse and I have spent a good amount on purchases of donar eggs for our infertility treatments.

  Are we able to deduct them as normal medical expenses, or do we need a special dispensation to do it?

    Hi @Jack11778 - thanks for asking an interesting question. 

     

    In general, infertility treatments for one or both spouses are considered medical expenses and are deductible per IRS Publication 502

     

    I do want to mention one unique scenario: I did find a Private Letter Ruling from the IRS where a same-sex (both male) married couple was not allowed to deduct expenses for surrogacy and IVF on the surrogate, because the medical expenses were incurred for a third party - the surrogate - and not for either taxpayer.

     

    But outside of that scenario, I see no reason that infertility treatments purchased for you or your spouse would not be a deductible medical expense.
