I cannot guarantee that you will receive your
portion of the refund, but that is the purpose of filing the Injured Spouse form
with a joint tax return.
The purpose of the Injured Spouse form is to separate items
from a joint tax return so that only the portion of the refund attributable to
the person who owes the previous debt will be used to satisfy that debt. Without the Injured Spouse form, this
division of the refund does not take place and your joint refund could be
seized.
