I was charged a penalty under Internal Revenue Code section 6698 (a) (1) for filing on April 7 2017. I was not aware that a LLC must file by March 15th. No warning TT

I have been using Turbotax Business since 2004 and every year filed in April.  This is the first that partnerships or LLC's must file in March.  Why would Intuit Turbo Tax not inform the user of the important dates?  I mean if I am using a business tax software that is always being updated, why wouldn't it inform the user of the dates to file what form on what date?

To the original poster, did you have any luck requesting the IRS waive the penalty? If so, can you give details? Did you call or write?

TT is software to provide assistance in completing the tax return.  It is not software that maintains due date reminders for the users.  Users of the business software should have some basic understanding of when tax returns are due; just as you are expected to know when your personal tax return is due.

Yes, the due date for the LLC tax return changed.  This change was passed in July 2015 effective for tax years that begin after December 31, 2015; effectively for 2016 calendar year taxpayers.

Write the IRS back and indicate that you were not aware of the change.  There is a good change that they will waive the penalty.

If this is the first year that you request that the IRS abate your late filing penalty, then it is most likely that they will honor your request.

Provide the facts, be cordial and send your letter certified mail return receipt requested.  This way you will have proof that the request has been received by the IRS.
