Even though that form was not part of your return, Kansas wasn't accepting returns until they got it updated. As of Feb 10th (today) you should be able to update Turbo Tax than go in and do the review process for the state and re-submit. I just did one and it worked.
I just tried as well and it won't let me, it just says "Transmission failed. The submission is a duplicate of one that was previously received. Please contact customer support."
If a tax return was already e-filed with the same name and social security number, you cannot e-file another return with the same personal information. You will have to print and mail your return.

It sounds like originally your Federal return was Accepted, but your Kansas return was Rejected?
In this case, you can Efile your Kansas return only, and not file your Federal return again (so you won't get a 'duplicate submission' error).

Does this happen if you pay the state fee for two returns? I have not filed twice?
No, paying for two state returns will not cause an issue. If a state return is rejecting because it is a duplicate submission, it sounds like you already filed. If you are getting a refund, check with the state website to see where things stand. See How do I track my state refund?
