How to Answer Questions for Dependent CA Form 3800 When Parents Do Not File in CA

My son was a full time student in CA for tax year 2024 and needs to file the 540NR.  He is not a resident of CA.  I claim him as a dependent on my tax return, and because he has taxable income he files Form 8615 with his federal return.  I am a resident in PA, and do not file taxes in CA, but Turbo Tax is asking for information related to my form 540NR in order to complete his CA Form 3800.  What do I enter here?

Additional details:  He has $12,959 in earned income on his federal return and $19,987 in unearned taxable scholarship income.  $6,445 of his earned income is sourced to CA, and $6,514 in FL, which does not have a state income tax.  Only $8,115 of his scholarship income was for attending school in the state of CA.  The remainder is for attending graduate school in the state of Florida.

What information is is asking for?

If you do not have any type of CA income and the question is asking for information from your 540NR, then you would enter $0 for the amounts that it is asking for.

Since you do not have a CA 540NR, you would answer No, tax on Children's income is not included.  Then you would enter $0 (or leave blank if it will allow you to) the lines for the income questions.

How do I differentiate between unearned income sourced to CA and other states?  It appears CA is taxing based on all unearned scholarship income from the Federal return, but not all of it is sourced back to CA.

If you go back through your California screens, you should come to a screen where TurboTax is asking how you're allocating the income. You should be able to enter the California portion of the scholarships on these screens.

If not, we can look at your return and see exactly what you see to help come to a resolution. The return will be scrubbed and won't include any of your personal details.

If you're using TurboTax Online:

Once you're logged in to your account and have your amended return open,

- on the left hand panel, click on Tax Tools and then choose Tools

- on the pop up window, select Share my file with Agent

- you'll see a message saying you'll give us a copy of your tax return. Your personal information will be changed so we can't see any private information.

- click okay and you'll get another message with a token

If you're using TurboTax Desktop:

  • Click on Online in the top menu of TurboTax Desktop for Windows
  • Select 'Send Tax File to Agent'
  • Write down or send an image of your token number and state then place in this issue.
  • We can then review your exact scenario for a solution

Please reply to this message with your token so that we can further assist you. Let us know all other states that are included on the return.
