Hello. I own an apartment I Poland that I pay monthly maintenance fee but didn’t rent out to anyone last year. Apartment needs full renovation and I will start renting next year. Can I deduct my fees from my income taxes?

No. You can't deduct maintenance fees if the apartment is not available for rent.

 

You can only deduct rental expenses from the day the property is put on the rental market.

To prove that you have start renting, you can use for example advertising listings for rental or by having an actual tenant paying rent. You do not need to provide these supporting documents to the IRS, but just keep them in your tax records in case of inquiry by the IRS.
