Filing a Childcare Expenses without Provider SSN or EIN

My Home Daycare Provider has not provided their SSN and may not depending upon the conversations we have had.  How can I file for the daycare expenses- I paid her in 2023 without this information?  I always E-file, so is that still possible?

Without provider information, you will not be able to efile and may have the credit disallowed. See About Form 2441, Child and Dependent Care Expenses which states: ....disallowed unless you can show you used due diligence in trying to get the required information.

 

This means you would need to write a letter explaining your efforts and providing as much information as possible about the provider. 

 

I recommend that you talk to the provider once again and explain to them that you are writing the IRS a letter and giving them every piece of information you know about the provider. If the IRS finds them, it will be added to their income with penalties a few years later- so the penalties grow. The provider may change their mind if you have enough good information and decide to cooperate with you. 

 

You might be willing to offer to help pay some of the tax on the money to get the information. Good luck and next time, get it all upfront.

I have proof of every payment made- which is on my side; but yes- I know for future as I am looking for new daycare now.   I appreciate the quick response.

You are welcome and we love to help! Your provider would need to file a sch C to claim the money earned as a baby sitter. The problem they run into is the Medicare and Social Security tax that must be paid on top of the income over $400. About Schedule C (Form 1040), Profit or Loss From Business. Too many people don't understand that this can go towards their future retirement or help if they become disabled. Again, best wishes.
