Dual-Status question

Hi,

 

I need to file dual-status this year and I want to check that I got my understanding right.

 

I lived in US and earned income (W2, stock) from 2022.1.1 - 2022.8.31. I quit my job at 2022.8.15. I left US for Canada on 2022.9.1 . I moved my investment to Canada on 2022.10.1 as well. I didn't earn anything from 2022.8.15 to 2022.12.31.

 

I assume I should file dual status with 1040NR as my primary form (ended year with NA status). And I should also file 1040 with Turbotax. Since all my income is earned when I was RA before 2022.8.31, I should be done with my tax after 1040. I probably will submit an empty 1040NR claiming no income for my NA period? 

 

Should I attach my W2 to both 1040 or 1040NR? Do I need to write a statement saying that my W2 is only earned from 2022.1.1 to 2022.8.15? Is there any additional deductions than itemized one?

 

Do I need to say anything about moving out my stocks outside US? Will it be considered as sale?

Dual-Status question

You do not need to attach your W2 to file your 1040 return unless you mail the return. You do not need to report moving your investments unless you cashed them out in the US and then opened up new investment accounts in Canada.  If this is the case, you would receive a 1099B for the sale of the investments from your US broker. If it is was a transfer of account between brokerages, this does not need to be reported.

 

If you have no income after you left the US, you do not need to file a 1040 NR unless you earned money from your investments while living in Canada between 8/15-12/31. If you do need to file 1040 NR and mail it, you do not need to include your W2 with the tax return.  If you do need to file 1040 NR, Turbo Tax does not handle this filing but out affiliate sprintax.com does. Please contact them for further assistance.

So from your expertise, do you think I could just file 1040 with Turbotax, print it out, and write "dual-status" on top of return and mail it, if I don't have income to file 1040NR?

What @DaveF1006 is saying, and I am agreeing with, is that you don't need to be dual status at all.  If you have no earnings after you left the US in 2022 then just file as a resident for this year and change your status with the filing for 2023.  Since your status change does not effect the tax filing in any way then simplify your life for this year.
