No. Since he passed away in 2024, on your 2023 tax return you can use the filing status of Married Filing Jointly.
When entering his personal information there will be a screen with a check box asking if they passed away before filing the return, check that box.
No. As of December 31st, you were still married, so you would still file as Married Filing Jointly or Married Filing Separately. There is a box to check that says he pass away before filing.
If you have qualifying children, then next year, you may be able to file as Qualifying Widow. Otherwise, if you do not remarry, you would file as single or head of household.
