Do I need to file form 3520 if money I received is not just for me?

Hi, thank you in advance for your time. I was wondering if I would need to file a form 3520 if I had the following situation this year as a US citizen? If so, would I do that individually or jointly with my spouse who is on an F1 visa but just had a green card application filed?

 

- Received 102k from my dad who is a foreign national overseas. The money was for both my brother and my tuition, but was wired to me then a little less than half was wired within the States to my brother 

 

- Received 49k from my father-in-law who is also a foreign national overseas prior to getting married

 

- My spouse received 49k from my father and mother in law each, totaling 99k

 

From my understanding I would file if I received more than 100k from a single foreign individual, but would I file if half money was transferred to my sibling? If I do submit the form for that 100k, do I need to submit the 50k from my father-in-law since it's technically from a "separate individual"? My spouse had received less than 100k from my in laws, but would we aggregate the money between us and have to file for that 99k? And between all these scenarios, would we file together if one of us is a US citizen, while the other isn't? Thank you so much!

Since you got the money just file the form ... it is informational only and you not owe anything on it so quit worrying and just do it.  See the form and instructions here:

You are MFJ, so together received more than 100k, so need to file joint 3520.  It does not matter whether you give the money to somebody or not.
