Do I have to have a EIN from the school for afterschool care that we pay to them?

If you want to e-file, yes. If you are paying for afterschool care to a public school district, they may be considered tax exempt and may not give you a tax number.   There is a box you can check for an exempt organization, but I believe that you can't e-file if your provider claims exempt, you would have to print your return and mail it in.
