Deceased, Not Married

My fiance passed away in 2021. We weren't married legally, however we lived together for 6 years and we had two children together. 

 

I was looking at Form 1310, and I noticed how the Number 3 Option when asking what your relationship is with the taxpayer was said: "As the person claiming the refund for the decedent's estate, will you pay out the refund according to the laws of the state where the decedent was a legal resident?" 

 

Can anyone explain that to me? I'm confused on exactly what it means. He did not have a personal representative appointed by the court, or a will. We were both legal residents of Georgia.

Deceased, Not Married

Yeah that just means you'll follow the laws of wills and estates in the state the deceased resided when you're distributing the property.
