My daughter has a W2 job and filed taxes on her own.  She lives at home with me

It depends.  Is she age 19 or older, not a full time student and had gross income of $4,300 or more in 2021?  If so, you cannot claim her as a dependent.

Thank you for your help.  She is 20 years old & yes she earned more than 4300.00 but she is a full time student & I pay her tuition.

Since she is a full time student and under the age of 24 you should be able to claim her as your dependent under the Qualifying Child rules where her income is not a factor.

 

To be a Qualifying Child -

1. The child must be your son, daughter, stepchild, foster child, brother, sister, half brother, half sister, stepbrother, stepsister, or a descendant of any of them.
2. The child must be (a) under age 19 at the end of the year, (b) under age 24 at the end of the year and a full-time student or (c) any age and permanently and totally disabled.
3. The child must have lived with you for more than half of the year. Temporary absences while away at college are considered living with you.
4. The child must not have provided more than half of his or her own support for the year.
5. If the child meets the rules to be a qualifying child of more than one person, you must be the person entitled to claim the child as a qualifying child.
6. The child must be a U.S. citizen or U.S., Canada or Mexico resident for some portion of the year.
7. The child must be younger than you unless disabled.

Again, thank you for your help.  With the criteria your gave me it looks as though my daughter would qualify for me to claim her as a dependent.  Problem is my returns keep getting rejected electronically as it is telling me I have an issue with my child dependents.  I have checked all SS #'s & made sure all info is correct.  Turbo tax is telling me I am fine, but the feds & state reject me return.  Only thing I can think of, is that my daughter filed and put something on her return that is not allowing me to use her a dependent? At this point I am getting frustrated and maybe I will remove her?  Believe me, the credit I get for her is not anything close to what she costs me per year!  Really wanted to just thank you for reaching out to help... I do appreciate it very much...  🙂

Yes, you can claim your daughter just make sure that when she files her taxes she states that someone else can claim her on her taxes.  That is the key.  My son is 20, works full-time and files his taxes, but I always claim him, especially since I support him.   There has never been an issue.  Note, he is not a student either.  As previously stated, ensure that your daughter when filing her taxes, checks the box that says someone else can claim her and will claim her.  Hopefully, this helps.

@Hi9cke1234 Your return is being rejected because she filed her tax return and did NOT indicate on her return that she can be claimed as a dependent.  She needs to amend her 2021 return and change her dependency status if you file your return with her as your dependent.

You will not be able to e-file your tax return since the IRS has already received a tax return with her Social Security number as a tax payer and not a dependent.

 

So, you have two choices.

1.  Remove her as a dependent on your tax return and e-file.  This option deprives you of the $500 Other Dependent tax credit.

2.  File your tax return with her as your dependent but it will have to be printed and mailed.  The IRS will pay you any tax refund from your mailed tax return.

Yes, sounds as if you can. 

As long as she was a student, under 24 and did not supply more than half of her own support you should be able to claim her. 

In this situation, her income does not matter.
