Can I still claim the dependent care credit for my daughter even if my ex was the one who actually paid for it and can show proof that she did?

Im claiming our daughter and my ex is claiming our son. I'm the custodial parent. Even though my ex can show proof she paid for daycare for our daughter when she was in her care, can I legally claim the dependent care credit?

As the custodial parent, you are entitled/allowed to claim the child and dependent care credit.  This applies even if you allow your ex to claim your daughter's exemption.  Technically if you are the custodial parent for both of the kids, you are the parent who should claim the dependent care expenses for both (and your ex would not be allowed to claim those expenses).
