1099R

In 2019 my husband took out a $20,000.00 loan against his 401K.  We have been paying it off through automatic withdrawal against his paycheck.  Well in 2020 he was hurt on the job and the workman's comp agreed to halt the payments until he started back to work.  He has been back to work but they have not started the automatic payments yet.   So we received  a 1099-R for $15,737.14.  Do I have to declare that as retirement?

Yes, you do have to declare this as income.  If the loan was not being paid back, then the loan amount would be treated as a distribution and a 1099-R would be issued.
