My grandson received a 1095-A just yesterday April 2,2025. He had no income for 2024 and was used as a dependent by my son (his father) on his tax return. My son submitted his return on March 27, 2025 but it kept getting rejected because it said someone was on the ACA in 2024. My son knowing that he had never had ACA insurance and my grandson had never had it either he certified that he had not received a 1095-A. It was accepted but my son called the marketplace and they did a search for his social and my grandson's social and it came back that my grandson had an account that he did not sign up for. My son reported to them that this was fraudulent and they said they would send it to their fraud department for investigation. Then on April 2, 2025 my grandson received a 1095-A in the mail. So my question is what to do about my sons tax return and does my grandson have to file a tax return now even though he had no income and this marketplace account is fraudulent? I don't want to amend my sons return and lessen his refund by submitting an 8962 form based on a fraudulent marketplace account.

If your sons return is processed, then you will not need to do anything. However, if he gets a letter in the mail for a return correction, then he will need to contact the IRS to report the fraudulent activity.
At this point do not amend the return since it is not something that was actually his. Wait to see how things proceed with the IRS.
Thank you fo the quick reply. Does my grandson need to file a return because he received this fraudulent 1095-A even though he did not have any earnings for 2024; he is a college student.
No. You do not report anything fraudulent on any return. If you do, then you are saying it is yours and not fraud. You are only to report true and accurate information on a return.
Also, if he is claimed as a dependent, then he would not include the 1095-A on his return even if it was not fraudulent. Only the person claiming him would.
