I need to file 1040 and 1041 for the deceased.....I have a 1099-div (in the name of the deceased) that has these amounts in these checked boxes...1a-ord div, 1b-qualified, 2a- total cap gains distribution
(this is a closed end fund) and when I put this info into turbo tax , the 1040 form line 7 (Capital gain or loss) says no schedule D required.....the closed end fund statement says all this activity took place after death, so can I submit it all on the 1041 even though this 1099 is under the deceased ssn...

Yes. If that is the only income that you have then you don't need to file the 1040, just the 1041. Enter the 1099-DIV in there and TurboTax will walk you through the rest.
that is not the only income I have, so I am reporting div on 1040 as well..... can I report a 1099-div with the taxpayers ssn on the 1041....I see that the 1040 lets you adjust the ordinary div, but can you also adjust the cap gains......
The capital gains is handled differently so the best solution is to report the income on your tax return as though it was issued in your name. You can nominee the document to yourself so the IRS knows where the income should be reported. See the information below.

Generally, if you receive a Form 1099 for amounts that actually belong to another person or entity, you are considered a nominee recipient. You must file a Form 1099 with the IRS (the same type of Form 1099 you received). You must also furnish a Form 1099 to each of the other owners.
File the new Form 1099 with Form 1096 (this is a transmittal for the 1099) by mailing to the Internal Revenue Service Center for your area. (Provided on the Form 1096)
