Can my husband and I file jointly even though he is the one that is only listed as the home owner on the mortgage?
Yes. If you are married then your choices are MFS or MFJ. Even if only one of you has income and/or deductions, you still file joint. For a married couple to file separate, you will always pay more in taxes that way.
