Someone please help - 8292 and 1095-A

I have insurance through my employer. I have 1 dependant I pay for all medicines, xrays, transportation  to dr. etc.   Without her knowledge she was added to the Healthcare Plan by her brothers friend for 3 months and the plan was paid for and not used.  I have the 1095-A.   The IRS is holding my refund because of 1095-A and 8962.

She is my dependant and did not use the Marketplace insurance she had 6/20 - 8/20 3 months. I have paid for everything which has drained my finances... What can I do they are holding my refund.

You will have to communicate with the Marketplace and explain to them that fraud was committed. Marketplace contact.

The dependant's dob is not on the form. I think her brother looked into it and then they opened it without her ok. She had it closed out and does not want any one in trouble.

They refused to do anything about it.  They said she had insurance. They got their money and -0- claims since that was never even used.  Now I have all these headaches & no one wants to help. :(

You should respond to the IRS as soon as possible.  If you have the form 1095A complete the form 8962 based on that information and write an explanation to the IRS.  The most important thing you can do right now is to respond to the IRS.  If you cannot reach them by phone write an explanation and attach along with copies of the 1095A and 8962.

 

The quickest and easiest solution is to complete the Form 8962 and send to IRS.  IRS is not requiring that you file an amended return but you can go through TurboTax to prepare the form 8962 using our amendment process.  Print and mail along with the form 1095A attached as IRS requested.

 

Form 8962 Premium Tax Credit is required when someone on your tax return had health insurance in 2020 through Healthcare.gov (or a state marketplace) and took the Advance Premium Tax Credit to lower their monthly premium. We'll help you create (or correct) the form in TurboTax.

 

You should have received a paper form in the mail from your marketplace. If you didn't receive a Form 1095-A, sign in to your Healthcare.gov account to download a copy.  Once you've got it, follow the instructions below for your version of TurboTax.

When you're done in TurboTax, you'll need to print out Form 8962 and mail or fax it to the IRS, along with any other items requested in their letter (IRS Letter 12C).

If there's a change to your refund amount or the amount you owe, you'll need to print and send page 2 of your 1040.

Remember:

  • Respond promptly.
    • If you disagree with the IRS, respond with an explanation—and with the item(s) they're requesting.
  • You don't need to complete or send a Form 1040X (amended tax return) to the IRS.
    • Send page 2 of your 1040 only if the refund or owed amount has changed.

Someone please help - 8292 and 1095-A

I sent all necessary forms. I should not have had this problem since my dependant did not use the insurance and asked to have it cancel because the Dr. was not part of the Network nor does he accept the insurance they had selected w/o her ok. The 1095-A does not even have the DOB. Ridiculous I should be penalized for something someone else did. Furthermore, the Healthcare Marketplace refused to make any corrections. This is totally terrible.

 

I was counting on the funds to pay back some of the medical expenses placed on CC. I don't have stimulus so I cannot count on that.
