Rejected due to dependent

I have separated from my ex and we have an agreement that each of us claims one of our children. He filed before me with both kids. He said that he put an exemption for my daughter in order for me to claim her. If she is on the form at all will that cause my return to get rejected? If so, do I need to file form 8332 first or what steps to I or him need to take in order to rectify this situation?

Unfortunately, you will have to paper file your return.  There is no way to get around the e-file system if a dependent has already been claimed on a return.  When the IRS receives your return, you and the other person who claimed the child will each get a letter requesting information to determine who the child lived with the majority of the year and has the right to claim the child.  If he received tax benefit he is not entitled to, he will have to pay that back.

 

The custodial parent is who the child lives with for more time during the tax year.

 

When you allow a non-custodial parent to claim a child, you are only releasing the ability to claim the child for Child Tax Credit under the special rule for divorced and separated parents.

 

The custodial parent retains tax benefits related to Head of Household filing status, Earned Income Credit, and the Child and Dependent Care Credit.  To be eligible for these credits, the child must have lived with you for more than half the year, so the non-custodial parent is not eligible for those credits.

Rejected due to dependent

TAx return was rejected due to dependent being claimed on another return.  I took the dependent off the return and then tried to efile.  have done it before but now turbo tax says there is no return for efiling..  I corrected the return.  what now?

You don’t provide a lot of information to work with, and your question isn’t really clear, but it’s possible that, without a child to generate any credits and a refund for you, your return doesn’t satisfy the IRS’s criteria for characteristics that allow a return to be e-filed.

One of the characteristics that might be missing is taxable income on your return.

Did you correct the return or did you accidentally amend the return ?   Look at the PDF of the return ... do you see a 1040X ?
