If the other parent is claiming our children, do I need to list them on my return anyway?

Please explain more-- what do you mean by "our" children? Who do the children live with -- or at least who did they spend at least 183 nights with?

If you are the custodial parent and allowed the other parent to claim the kids (you should give the other parent a signed Form 8332) you can still list the kids on your return and claim child care credit and earned income credit and file as head of household assuming you are otherwise qualified for those benefits.
