Amend

My husband and I filed and claimed our kids. Oldest son did his taxes and had to say yes, that someone else was claiming him. As a result, he did not get his stimulus. Can we amend that even though $700 of our return was taken for a child support issue?

Are you intending to amend your return so that you will not claim your son with the intent that he will amend his return and claim the stimulus?  That won’t work since if you CAN claim him m—even if you do not—he still has to say that someone else can claim him m and he then is not eligible for the stimulus. By the way, amended returns take about 5 months to process.

I see. Yes, I was. He’s 19 and working. I’m not familiar with the rules. Is there a certain age when you cannot claim a child?

Was he a full time student?  If he is under 24 and a full time student you can still claim him no matter how much he makes.  If he is over 18 and not a full time student you can only claim him if he made less than 4,300 total for the year.  You can only get the first 2 stimulus payments for dependents under 17.  No age limit on the 3rd one.

If you can not claim him then he can file independent and get his own stimulus.  He can amend his return.

If he was 19 years old in 2020 and earned more than $4,300 you can’t claim him.

He was not a full time student, and made a bit under $4,000.

If he made less than 4,300 then you can claim him.  Sorry no one gets the first 2 stimulus for him.
