TT 2023 H&B desktop says you cannot take new EV credit if your income is over $150k/$300k in either 2022 or 2023. This is incorrect.
Correct is:
If your income is under these limits in one of the 2 years you qualify for the credit. Please have software corrected.

This error is still in TT Desktop as of today (03/25/24). If your income is below $150/300 in either 2022 or 2023 you qualify per IRS guidlines. TT says if it is over in one of the 2 years you do NOT qualify.

You can use your modified AGI from the year you take delivery of the vehicle or the year before, whichever is less. If your modified AGI is below the threshold in 1 of the two years, you can claim the credit. The credit is nonrefundable, so you can't get back more on the credit than you owe in taxes. You can't apply any excess credit to future tax years.
