Lawsuit lichten against uber

Can I deduct attorney fees?I received from Lichten lawsuit against uber 1099 misc ( it was regarding Misclassification of drivers as independent contractors)
They charged me attorney fees and Then they added it in my total income as Other income “ which I never received “ , my question is, is this attorney fees deductible if yes, where can I deduct it?

Lawsuit lichten against uber

No.  Legal fees are not deductible under current tax law unless it is specifically to do or keep your current job or related to business, farming or investments. 

 

Since this was a class action suit, you would not be able to take a deduction for the attorneys fees as this would be considered a personal nondeductible expense.

If your income from Uber is reported on a form 1099-NEC and you report it as self-employment income on your tax return, then you can deduct legal fees of the sort you mention as they were an ordinary and necessary expense of your business.

This was a settlement check from Lichten firm against uber on basis ( Misclassification of uber drivers as independent contractors) 

the Lichten firm charged me attorneys fees but they included that amount in my total income, 

I was wondering if I could deduct attorney’s fees from my gross income ?
