just a few questions

1. i was married in july but we want to file married filing separate, how dows this effect ones taxes or is it smarter to file together?

2. my 6 year old son was awarded SSI in august of 2021.  how do i file taxs differently this year when i still have 2 other dependents?

#1.  You should file a Joint return.  May I ask why you want to file Married filing Separate?


Unless you have a specific reason to file separate returns,

It is usually better to file Joint. Joint has the lowest tax rates and the highest Standard Deduction. And if you are in a Community Property state MFS gets tricky to figure out. Here's some things to consider about filing separately……

 

In the first place you each have to file a separate return, so that's two returns. And if you are using the Online version that means using 2 accounts and paying the fees twice.

 

Many people think they come out better when filing Married Filing Separate but they are probably doing it wrong. If one person itemizes deductions then the other one must itemize too, even if it's less than the standard deduction, even if it is ZERO!

 

And there are several credits you can't take when filing separately, like the

EITC Earned Income Tax Credit

Child Care Credit

Educational Deductions and Credits

 

And contributions to IRA and ROTH IRA are limited when you file MFS.

 

Also if you file Married Filing Separately up to 85`% of your Social Security becomes taxable right away even with zero other income.

#2  Your son's SS won't affect your return.  You can still claim him and your other dependents as normal.   You don't report his SS on your return.  He does not have to file a return for himself for SS.

the reason would be his exwife filing for child support behind his back when they had a 50/50 agreement. and i am afraid they will take all of our money.

Hi Kristnabarnes,

A marriage in July of 2020 is no different than being married on December 31, 2021. If married at any point during the year, The IRS considers that you were married for the entire year. If you should file married filing separately, you would certainly lose the Earned Income Tax Credit just to name one of the many credits that will not be available to you. In addition, the tax levied on Married Filing Separate coulples can also be increased. In most cases, Married Filing Jointly provides  a better tax break.

 

As far as filing for your 6 year old, SSI has no effect on the taxes and the child should be included along with your other dependents.

 

If there is a situation with an ex-spouse, going forward will depend on who has the child for the majority of the year AND if there has been an agreement as to whom has the right to claim the child.
