filing non-resident return for earnings from a sale

I sole a property in WV. Being a non-resident, WV has a 2.5% withhold tax that I am supposed to be able to get returned since I sold it at a loss. I am using TurboTax deluxe and downloaded the additional WV state return, but I do not see in the walkthrough where I can enter in sale/loss information or anything from the 1099-S that I was sent from the sale. Does TurboTax deluxe have the capability to do this? If it does where is the section I can property enter the information? If it does not how can I get a refund of the $40 for the download as it is worthless to me?

Yes, you can enter the sale of your property in TurboTax.  You will need TurboTax Online Premier or TurboTax Download/CD Deluxe to report the sale.

 

If you sold a home, there is a "Sale of Home (gain or loss)" section.

 

If was not a home, but investment property, you report is in the "Stocks, Mutual Funds, Bonds, Other" section.  Answer No to the "receive a 1099-B" question, and then answer according to the type of property sold.

 

If it was business property for a business you report in TurboTax, you indicate in the interview for that business that the property was sold during the year, and TurboTax will walk you through the entry of the sale.

 

If it was business property not otherwise entered in TurboTax, you enter the sale in "Sale of Business Property" section.

You have to file a WV non resident return to report the sale and claim a refund.

You actually enter the 2.5% WV withheld tax in the federal section of the TurboTax (TT) program.

 

In TurboTax (TT), enter at:

Federal Taxes Tab

Deductions & Credits

-Scroll down to:

--Estimates & other taxes paid

   -Other Income taxes

On the next screen, scroll down to

     -Other income taxes paid in 2019 

       -  Withholding not already entered on a W-2 or 1099

         -On the next screen, enter the amount of withholding and the state

 

You may want to mail your WV return (rather than e-file) so you can attach a copy of the form showing the withholding.

Depending on how the property was used, you may not get a deduction for the capital loss, on the federal return. You may claim a loss on investment property, including vacant land.  You may not claim a loss on the sale of personal use property, like a 2nd home.

Hello, I have almost exactly this same situation, but I filed form WV/NRER "Application for Early Refund of Withholding of Sales of Real Property by Nonresidents" and received an early refund. West Virginia says that I still need to file a tax return. When I enter in the tax withholding information into TurboTax, it's saying that I'm  due a refund. However, I don't see where to enter information about the early refund I received. Ideally, the WV amount due would be $0 because I already received an early refund. Is there somewhere in Turbotax to report an early state refund? Thanks!

For withholding, enter the net amount  (original withholding less the refund).  You should probably attach a statement explaining that.
