I refinanced my Home Mortgage Loan, 30 years fixed, through one bank and it was closed in Feb 12, 2021 and the first Mortgage payment was due on April 1, 2021. I paid 1.75% of Loan Amount as points to get a low fixed interest rate for 30 years.
This is not a cash-out Refinance Home Loan.
But the Home Loan was then sold to another bank on March 15, 2021 and made my first Mortgage payment to the second bank before April 1, 2021.
I do have letters from both the banks that the loan was sold from the first bank to the second bank on March 15, 2021.
I received a 2021-1098 Tax Form from the second bank which lists only the Mortgage Interest paid from April 2021 to December 2021 and has no reference to the points I paid to the first bank.
The first bank is stating they may not send me a 2021-1098 Tax Form listing the Points I paid for my loan from them but I can use the HUD Closing Docs to report them using Itemized Deductions on my 2021 Tax Return.
Normally since this is a refinance loan I need to amortize the points over the life of the loan like 30 years.
But since the two lenders are different above I should be able to write off all the points in my 2021 Tax Return.
Am I wrong in my above assumption that I can write off all the points or should I amortize over the life of the loan?

No, transferring or selling a loan between services is not the same as refinancing and paying off the loan. You still need to allocate your points over 30 years.
