Can I claim medical expenses for the $25,000+ I had to pay back to my personal medical insurance out of a personal injury settlement?

I received a settlement for a personal injury I incurred and had to pay over $25,000 back to my personal medical insurance company. I don't know if I can claim that as medical expenses on my tax return this year?

Since the medical expenses were reimbursed by the insurance proceeds, they are not deductible on your tax return.

Q.  Can I  claim that as medical expenses on my tax return this year?

A. No. That assumes the settlement was not taxable.  Since you paid the medical expenses, with tax free money, you cannot claim a medical expenses deduction. 

 

Otherwise, bills paid, in the current year, for medical services, received in a prior year, are deductible on the current year return, if paid with your own after tax money.
