If the real estate taxes are paid from funds from a joint account, the real estate taxes should be divided between you and your spouse's return. Otherwise, you can deduct the expenses on your return.
See the following from IRS Other Deductions Questions:
Answer :If you and your spouse file separate returns and one of you itemizes deductions, the other spouse must also itemize, because in this case, the standard deduction amount is zero for the non-itemizing spouse.
I see that since I pay all the property taxes on a home only I own, My husband does not get to deduct half the property taxes. But the taxes always get reduced by TT on my return as it assumes since I am filing separately, that my husband also gets to deduct half. But he is not an owner and cannot deduct. The funds paid for taxes in this case are not in a joint account.
How do I override this in Turbo Tax? I seem to always lose the $5000 of deductions.
Well that section of the Sch A is limited to $10000 for a married couple however if you file separately then you only get $5000. So since he must also itemize deductions when you itemize deductions then he should claim the rest that you can't claim OR file a joint return.
