Work in SC, but taxes mistakenly withheld for NC

I live and work remotely in SC but my state income tax for 2021 was withheld for NC erroneously. My employer states that this can not be corrected on their end. I had already filed my federal return before I realized this error. Should I file for NC as a non-resident and report no income to recover the withholdings, then file an SC return? Do I need to file an amended federal return?

Yes, file a North Carolina return with zero income as a non-resident.  

Please see the TurboTax Help article How do I file a nonresident state return? for guidance.

An amended federal return isn’t necessary.

Excellent, thank you. Does the order of the returns matter? In other words, once I file the NC return as a non-resident with zero income, do I need to wait for that return to be accepted before I file the SC return?

No, you do not have to wait for it to be accepted before filing the South Carolina return.  However, you should complete the North Carolina return first and then work on the South Carolina return.

 

If you have a South Carolina balance due since taxes were not withheld, you can still go ahead and file the return now.  You will have up until the tax due date to actually pay the balance due.
