WFH in WA but a company at CA

I work for a California's tech companies who allows their employees to work from anywhere until at least August 2021. However, said tech company is still collecting and sending my wages/salary to the state of CA although I'm not a resident of CA. (I'm a resident of WA because I stay in WA for a long time and I took the job offer at end of 2019, but back to WA and WFH at March 2020, so I never step up CA resident)

 

To be clear on my situation above:

- was hired for onsite work in California, but only stay in California about 1 month in 2019 and 2.5 months in 2020.

- my employer continues to withhold CA income taxes to California's Franchise Tax board

 

My questions:

- I should be entitled to receive a refund of my income taxes for April 2020 - Dec 2020 or not?

WFH in WA but a company at CA

It appears that as an employee who is a CA non-resident and working outside of CA even if for a CA based company you would not be taxed on the income earned while outside of CA.  So you would figure your CA taxes with 9.5 months of income not CA sourced.  

 

In the "My Info" section you will indicate WA as your resident state and that you earned income in another state (CA).  That will generate a CA non-resident return.  In the CA interview you will be asked to allocate the days (wages) earned inside and outside CA.
