1099-r needs to be changed for the correct resident state - military family

So I have a 1099-R that has my correct address in CA  but that is not my state of residence. My state is Oregon. 

 

I have called the Trust Company who issued the 1099-R to reissue it with the correct address. They pretty much said no - that they really do not know how to do it. 

 

I have not filed my taxes yet for state because I would like this to be resolved before I file the state taxes.

 

Please help - I want it corrected by the Trust company but it sounds like it will probably be a not even though I think it can be done. 

 

What makes this more complicated is that the Self directed IRA - the money was used to purchases land in New Mexico. The "Profit" I have to say I took out is land that I have not sold and do not have any "real" cash. I just have the title to the land. I do not actually have the money in my bank.

 

Who do I file taxes to?

How can I get CA to not be in box #15 on the form 1099-R?

You don't have to file a tax return for California if you didn't live there or have any income from sources within that state. It is possible California will contact you in the future and ask about the income, but you can explain what happend and that may resolve the issue. There is nothing you can do to amend the 1099-R form, only the company who issued it could do that.

I asked the company to do it and they seem to can't figure out how to admen or revise/reissue the 1099-R to me

Do you know if they can reissue it - they think it is impossible.

 

Thank you for the answer - I did not make any money in California - not employed here is CA.

 

Do you think I need to file for New Mexico because the land is in New Mexico but is not sold?

 

My state of residence is Oregon. I filed the income for Federal but do you think I need to report/file it for Oregon?

1. Give up on trying to get them to re-issue the 1099-R...see #2.

 

2. Is there a dollar amount in box 14? If so, then the trustee has already sent this withholding to the state of California. This is why they just can't "change" it - the money is gone to California. The only way you can get it back is to file a California return and show that you owe no tax there. 

 

3. Make sure that you immediately notify the issuer of the 1099-R that you don't want any tax withheld for California in the future (point out that many military members don't pay tax to the state they happen to be living in).

 

4. Was the purchase of the land inside the IRA or outside? You owe no return or explanation to New Mexico in either case. The "income" you are referring to was a withdrawal (distribution) to buy this land outside the IRA, right?

answer #2 - There is no dollar amount in Box 14

answer #3 - Since I took the money out of the Trust company and out of an IRA - they no longer have anything of mine. I no longer have to pay them for the Self Directed IRA that I have gotten out of. Thank you for the information so I can do it right for my other accounts.

 

Answer #4 - It was purchased with Traditional IRA money that is why it was in a Self Directed IRA. I was able to get out of it without selling the land. I just took the land out (or IRA) to purchases the land myself. It just turn the title /deed to me for the land. I still own the land -it is just not an IRA anymore since I took it out. 

 

Sorry if it sounds confusing - I wished I never did it. The land is not worth much that is why I thought I just take the penally and be done with it since the manual fee foe this Trust company to manage my IRA (land) had increased.

If there is no dollar amount in Box 14,  you can delete CA from box 15 and leave it blank.   In fact, if box 16 is empty, TurboTax will give an error if anything is in Box 15, so leave it blank.   They did not send any withholding to CA, so you don't have to file anything in CA.   And since they no longer have anything of yours, you won't have to worry about it in the future.  😉
