NJ 1040NR filing status

per NJ 1040NR instruction: "If both you and your spouse were nonresidents for the entire tax year, and only one of you had income from New Jersey sources, that spouse can file a separate New Jersey return even if a joint federal return was filed. The spouse with income from New Jersey sources calculates income and exemptions as if a federal married, filing separate return had been filed. You have the option of filing a joint return, but in that case, your joint income would be reported in column A of Form NJ-1040NR."

 

This is the exact case for our family. We would like to file NJ-1040NR as married filing separately while we have a joint return for Federal and NY taxes. However, I couldn't change the filing status on Turbo Tax to married filing separately for NJ. Anyone can help? Thanks

NJ 1040NR filing status

Yes. You can’t file a joint federal return and a separate state return in TurboTax Online. You’ll need TurboTax CD/Download.

Once your installed CD/Download and opened your tax return, you’ll use your joint return to create a mock Married Filing Separate return to prepare and file New Jersey.
