The state of NY will review your returns. If they are correct then the amount due/refund will be processed. So if your non-resident return shows a refund there should not be any penalties/interest. If there is a tax due then the penalties and interest will be assessed based on the new correct tax due.
Also, I believe you mentioned you filed amended NJ returns. Hopefully you claimed the credit for taxes paid to another state for the NY tax on non-resident NY income.
Any idea how long it will take to review the non-resident forms submitted and make any necessary updates to the penalties and interest? My NJ forms did include the @W-2s for both NJ and NY.
Also, should I be sending my federal and NJ accepted documents from 2017 and 2018 to the state of NY so they have a copy? Just curious.
Not to NY, but a copy of your NY return should have gone to NJ for the credit for taxes paid to another state claim.
However, if you have already submitted don't send anything else as that may just cause confusion. Just allow the taxing agency to contact you if they need additional information.

My employer paid income tax to NYC. I lived in NY but not in NYC. How do I get a full refund of this amount?
As a non-resident, you would file IT-203 (TurboTax will do this for you). The New York City income tax is part of the New York State tax return, on lines 51 to 55 (for the most part).
TurboTax will calculate your New York City tax (presumably zero if you were a non-resident of the City or Yonkers) but will add your NYC withholding to your NYS withholding, so you should get your money back.

Since the taxpayer is a resident of New York State, I believe he would file NYS Form IT-201, allocating zero income to NYC on Line 47.
Tom, of course, is correct, that you will file as a NY resident (IT-201) - but the mechanics of how you get the money back will be the same.
My apologies, but I was just doing a question about a Florida resident doing a New York return, and confused the two questions...but it doesn't matter because TurboTax would have given you the correct NYS form anyway.
And just to clarify, the lines about the NYC wages appear on lines 47 to 58 (with other stuff in between), and the NYC withholding is on line 73.
Hi, I moved to Illinois in Sept 2020 to start a new job; I filed my taxes last year using Turbo and received a State refund from California. However, this year 2022; I've been working and living in Illinois fulltime, and my job has been taking taxes out of my check and paying California! I didn't realize this until I got my W2 this year.
When I got my W2 this year, I saw that they were taking taxes out for Illinois and sending taxes it to California too. So, I have been double taxed. I work at The VA Hospital in Hines, Ill. They told me to just go on to file my taxes. But, it's not that easy when your not a tax expert and it was not my error. I just assumed they knew what they were doing. But it was in 202 at the beginning of Covid so here I am, in a big mess....
Unfortunately, I'm trying to process my taxes now; however, when i try and enter the 2 different state the program will not let me. It states that the move date must be before 1/1/2021. I need some real help to complete this year's taxes.

For tax year 2021, you must file a non-resident California tax return on which you allocate zero income to California. This will result in California refunding the incorrectly withheld taxes. My answer assumes that you were an Illinois resident for all of 2021.
Thank you! I lived and in California from January thru mid-September 2020. Then I got offered a job and moved to Illinois' and was working and living there from September to December of 2020 and currently.
I am living in PA and working in NY, my company withhold NJ tax also. So i have to file NJ Tax return also for full refund or I will get credit in PA. Tax Return.

No. You will need to file a NJ state return to receive a refund for your NJ taxes that were withheld.
