I was a part year resident of NY and my husband was a non-resident with no NY source income; we file federal joint. The NY tax website says I should file a joint IT203 (with my name and SSN on top and only his SSN) return along with IT203C. The instructions also say that only I should sign IT203. However, the cover page of Turbotax e-filing instructions say: "Since you are married filing jointly, your spouse must also sign and date the form" and Turbotax lists both of our occupations on the signature line for IT203, next to where signatures go. So if we e-file, does Turbotax e-sign for both of us even though only one of us should? Is there a way to correct this? Would the e-file go through?
IT203B: Turbotax incorrectly puts both our names on the form and my husband's SSN even though the instructions say it should follow IT203 ie have my name and SSN. Any advice on whether I should override this?

Go back to the NY state tax section. Make sure you indicate that only you had NY Source Income.
On the screen asking if all of your wages and/or self-employment income was earned in New York State, choose no.
When you're asked if your husband had wages, be sure to choose no. If you see a W-2 summary screen, even if it shows $0 in wages - delete it.
With these answers, your IT-203 should update to just your name.
Thanks - I did as described and did not have a W2 summary screen to delete. The IT-203 shows both our occupations and the TurboTax cover page instructions said that both need to sign as it is a joint return.
