What if I have not changed my residency from my old state?

If you did not establish a new state domicile and intend to abandon your old state domicile, you may be able to keep your old state residency, regardless of how long you did not live in your state of residence.  However, some states apply a "TAX RESIDENT" rule that says it may not actually be your state of legal residence/domicile, but you were in the state long enough for them to be able to tax you as if you were a resident (usually 183 days).  Also, remember that a state can tax you on state source income (if you worked in the state) even if you are a nonresident.
