I have a related question - if I'm an independent contractor who works for a company located in DC, but I live elsewhere and work remotely from home, do I owe DC income tax? Thanks!

Only DC full or part-year residents are subject to DC income tax.  DC income earned by a non-resident is taxed only by the non-resident's home state, assuming of course that the non-resident's home state has an income tax.  See "Do I have to fie a DC income tax return?" in this reference:

Thanks @TomD8 ! Very good to know. Luckily I live in New Hampshire so looks like I'll only be paying federal income tax for the time being!

Thanks, but I didn't know this until after I spent the $40.00 for the DC "state" tax extension to TurboTax Deluxe.

 

TurboTax knew I had no DC tax withheld and that I didn't live in DC at all in 2020, so why did it let me spend the $40.00 ?

I have been doing this for three years and just now found this thread. I am infuriated that TurboTax basically insists that we need to file a non-resident DC tax return even though we owe and receive nothing - I'm pretty sure I've paid $150 to TurboTax for this nonsense over the years, not to mention the postage to send a written note with the instruction page explaining I did not receive a tax return document to send, just to cover my bases. So flipping annoying. This is my last year with TurboTax - thank you for making that decision easy.

@NotADCResident  You can reach out to customer service to request a refund.  In the Personal Information section, selecting no that you did not work in another state other than your home state will prevent the DC return from generating.

@maglib If one is a passive member investor in an LLC that invests in DC property, assuming either periodic income or liquidation gains, is a DC return filed, assuming no other connection to DC?

If this person is in a partnership LLC then the partnership would file a DC return not the partners.

Fair enough, but if it shows income, would there be withholding for non-resident members, or all members?  And if the member has no nexus to DC other than the investment, is the member entitled to a refund, subject to filing its own return in DC?

LLC members are not employees and thus are not subject to tax withholding.

 

DC residents may subtract on their personal DC tax return any income that is also taxed on a DC franchise tax return.

 

Whether DC non-residents can take a credit on their own state tax return for DC franchise taxes paid will depend on the tax laws of their own state.   This usually depends on whether or not their own state regards the DC franchise tax as an income tax.

These are questions you should pose to the person in charge of the partnership books and income tax filings.  If you don't understand the K-1 form you get from the partnership then ask them to explain it to you.

@Curious One  Sorry, I didnt respond sooner.  I dont monitor during off season. 

 

The LLC can and should file a return as an entity and it flow to the individuals. 

 

"On or before the due date, including any extensions, for filing the original tax return, an affiliated group may elect to consolidate the taxable income of all members of the affiliated group. The election shall be binding on the affiliated group; provided, that the election shall terminate automatically upon the revocation or termination of its federal consolidation election."  https://code.dccouncil.us/us/dc/council/code/sections/47-1805.02.html

You need to escalate the matter to higher levels of Turbotax customer support. The first person I talked to didn't know anything, but a higher-up person to was able to sort out my return (essentially, delete the DC part) and refunded the cost of the DC filing. However, it would be good if Turbotax got this issue sorted out for next year.

It is 2025, and TurboTax forced me to file a DC tax return because I work in DC and live in Virginia. despite the fact that I do not expect a refund or owe any taxes to DC.  I already filed an exemption to pay taxes in DC as a non-resident. Why is Turbotax asking me to print a return, but there are only instructions, and no actual form, asking me to send all W2's, 1099s etc, if the DC government does not require a person to file anything unless there is a refund or amount owed?  Apparently, this has been going on for years, judging by the comments from several years ago. Is this a scam from Turbo Tax? TURBO TAX I NEED A REFUND. WHAT YOU ARE DOING IS FRAUD!!
