I received a request for information from the NC Dept of Revenue in Raleigh, NC. They would like me to submit copies of all W2s and 1099s for 2016. is this legitimate ?

Yes. I did not work in 2016, thus no W2s. I moved during the year from Georgia to North Carolina. I did take out some money from my 401k and thus, have 1099 forms. I believe I am due to refund from North Carolina per turbo tax that I completed. Please advise asap.

If the request came in the mail, rather than phone or email, it is most likely legitimate. There should be a phone # and address that can be verified at the DOR website (http://www.dor.state.nc.us/).

 

The letter should also explain why they are asking for this documentation. The usual reason is that the withholding you show on line Line 20 of form D-400 does not match the info they received from the payer sources. Since you don’t have a W-2; they most likely want to see a 1099-R, with an amount in box 12 that justifies the amount on Line 20 of form D-400

It is likely legitimate.  (You can probably check the address using google maps if not a PO box), or check it against the various addresses here:   http://www.dornc.com/aboutus/offices.html

Return to them, a copy of any 1099-R form you received that shows NC withholding .  And include a letter explaining when you moved from GA to NC, AND, what date you removed $$ from your 401k.  Whether the 401k withdraw was GA or NC-taxable depends on exactly when you removed the $$.  A statement showing the withdraw from the 401k account or a monthly bank account statement showing the deposit,  would help there to show when you got the money..... and the fact that you had no other income.  (What, no bank interest?  no mutual fund distributions at the end of the year?).  Send that off to them.

But...there is no way for you to get an NC refund without NC withholding on your 1099-R form.  It could be that you didn't fill in the part-year NC tax return income allocations properly and they are questioning your entries...The tax software can't know if you mis-entered something entirely..
